1. Acceptance of Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“the User,” “you,” or “your”) and Nonna’s Shop (“we,” “us,” or “our”) governing your access to and use of our website, including all content, functionality, and services offered.
By accessing or using this website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the website immediately.

2. Eligibility

You must be at least eighteen (18) years of age or the age of majority in your jurisdiction to use this website. By using the website, you represent and warrant that you meet these requirements and that all information you provide is truthful and accurate.

Nonna's Shop and its parent companies do not intend to collect information from children who are under 13 years of age. If you are under 13, please do not provide us with any information. Parents and guardians may ask to review this information if it is erroneously collected.

3. Nature of Services

Nonna’s Shop operates as an online marketplace and intermediary platform connecting consumers with independent third-party vendors and suppliers.
We do not manufacture, warehouse, or directly fulfill most products offered through our website. Our role is limited to facilitating transactions between customers and vendors.
The vendors and suppliers are responsible for the manufacture, fulfillment, and quality of the products they provide. Nonna’s Shop does not act as the seller of record for such goods.

4. User Accounts

Users may be required to create an account to access certain website features. You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. We reserve the right to suspend or terminate accounts, without notice, if we suspect fraudulent activity, misuse, or breach of these Terms.

5. Purchases and Payment

All prices displayed on the website are denominated in American (United States) dollars (USD) unless otherwise indicated. Prices and availability are subject to change without notice. By completing a purchase, you authorize Nonna’s Shop or its designated payment processor to charge your chosen payment method for the full amount of the transaction, including applicable taxes. You agree to provide accurate billing and contact information and to ensure sufficient funds for payment processing.

6. Custom and Personalized Products

Certain products available through Nonna’s Shop may be customized or personalized at the customer’s request. All products are final sale and non-refundable. Please review all customization details carefully before placing your order. 

7. Shipping Policy

We do not manufacture, store, or directly ship most of the products offered through our website. All orders are processed and fulfilled by our vendor partners, each of whom is responsible for production, packaging, and delivery of their respective products.

Vendors select the most suitable shipping methods and carriers for their products.
Nonna’s Shop does not control shipping methods, courier selection, or route decisions.
Tracking information will be provided by the vendor or carrier only when available and is not guaranteed.

Any delivery timelines provided on our website or by customer service are estimates only and do not constitute a guarantee.
Delivery times may vary due to factors including, but not limited to:

  • Vendor production capacity

  • Carrier delays or disruptions

  • Customs inspections or international transit issues

  • Weather conditions or unforeseen logistical challenges

Nonna’s Shop cannot guarantee delivery within a specific time frame.

Nonna’s Shop shall not be held liable for shipping delays caused by third-party carriers, suppliers, customs agencies, or other external factors beyond our control, or the loss of deliveries. Nonna’s Shop does not assume responsibility for lost, stolen, or damaged packages once they have been handed over to the shipping carrier. This includes delays or losses due to natural disasters, strikes, political events, pandemics, or other acts of force majeure. 

Some products may ship from international vendors. Customers are responsible for all customs duties, import taxes, and related fees imposed by their local authorities.
Delays due to customs inspections are outside the control of Nonna’s Shop and its vendors.

If a vendor fails to fulfill an order, Nonna’s Shop will make reasonable efforts to facilitate communication between the customer and vendor. However, Nonna’s Shop is not the seller of record and assumes no liability for fulfillment errors or non-delivery by third-party suppliers.

8. Refund Policy

Most products available on Nonna’s Shop, including custom, non-custom, personalized, or made-to-order items, are final sale and non-refundable. This includes products featuring engravings, names, dates, or other customized details.

Once an order has been submitted to the vendor for production, it cannot be changed, canceled, or refunded.

Each vendor is solely responsible for:

  • The quality and accuracy of their products;

  • Fulfillment and packaging; and

  • Addressing any issues related to product defects or errors.

Nonna’s Shop does not process returns or issue refunds directly

If a product arrives damaged or defective, customers must notify us within 7 days of delivery by contacting support@nonnas-shop.com with the following:

  • Order number,

  • Description of the issue, and

  • Clear photographs of the product and packaging.

Nonna’s Shop will liaise with the vendor to assess the situation. If the vendor confirms a defect or production error, a replacement or refund may be issued at the vendor’s discretion. Approved refunds are issued only after vendor confirmation.
Refunds will be processed using the original payment method, subject to payment processor timelines (typically 5–10 business days). Nonna’s Shop does not guarantee specific refund timelines and is not liable for payment delays caused by banks or financial institutions. Nonna’s Shop is not responsible for damages caused by mishandling, misuse, or shipping incidents beyond vendor control.

All disputes regarding product quality, fulfillment, or refund eligibility must be directed to the vendor responsible for the order. Nonna’s Shop may facilitate communication between the customer and vendor but is not obligated to mediate or resolve disputes.

Nonna’s Shop assumes no liability for refund denials, vendor decisions, or customer dissatisfaction arising from third-party products or services.

Initiating a payment chargeback without contacting Nonna’s Shop or the vendor to resolve the issue may result in suspension of account privileges, the involvement of collections agencies, or future order restrictions. Fraudulent claims or misuse of the refund process will be reported to payment processors and relevant authorities.

9. Product Descriptions and Representations

Product information, descriptions, images, and specifications are provided by third-party vendors. While Nonna’s Shop strives to ensure the accuracy of product listings, we do not guarantee that product details are accurate, complete, current, or free from error.
Colors, sizes, and materials may vary due to production differences or display settings. Nonna’s Shop is not responsible for discrepancies in product presentation or vendor information.

10. Fulfillment and Delivery

Fulfillment, packaging, and delivery are performed by third-party vendors and suppliers.
Nonna’s Shop does not guarantee specific delivery timelines and is not liable for shipping delays, lost parcels, or damage occurring in transit.
All risk of loss transfers to the customer upon the vendor’s delivery of the order to the carrier.

11. Warranties

Nonna’s Shop does not provide any warranties, express or implied, for products sold through the website.
Any warranties or guarantees, if applicable, are provided directly by the vendor or manufacturer.

Users are responsible for contacting the vendor regarding any warranty or defect claims.

12. Vendor Responsibility

Each vendor or supplier is solely responsible for:

  • The quality and safety of the products they provide;
  • Compliance with applicable laws and regulations;
  • Product descriptions, pricing, and representations; and
  • Order fulfillment and customer service related to their goods.

Nonna’s Shop assumes no liability for acts, omissions, or representations made by vendors.

13. Dispute Resolution Between Customer and Vendor

Any disputes or claims related to product quality, fulfillment, or delivery must be directed to the relevant vendor.

Nonna’s Shop may, at its sole discretion, facilitate communication between the parties but is under no obligation to mediate or resolve such disputes. Refunds, replacements, or remedies are provided solely at the discretion of the vendor.

14. Intellectual Property Rights

All intellectual property rights in the website and its content, including text, graphics, logos, product designs, and images, are the property of Nonna’s Shop and are protected by applicable copyright and trademark laws. You may not copy, reproduce, distribute, or otherwise exploit any material from the website without prior written authorization. Trademarks and product names of vendors remain the property of their respective owners.

15. Prohibited Conduct

Users must not:

  • Use the website for any unlawful or fraudulent purpose;
  • Interfere with or disrupt website functionality or security;
  • Upload or transmit viruses, malware, or harmful code;
  • Infringe upon the intellectual property or rights of others; or
  • Engage in any conduct that may harm Nonna’s Shop, its users, or vendors.

We reserve the right to restrict or terminate access to any user engaging in prohibited conduct.

Such links are provided for convenience only. Nonna’s Shop does not endorse, control, or assume responsibility for the content, policies, or practices of third-party sites.

17. Disclaimer of Warranties

The website and all content, services, and products are provided on an “as is” and “as available” basis. Nonna’s Shop makes no representations or warranties, express or implied, regarding the operation of the website or the accuracy, completeness, or reliability of its content.

18. Limitation of Liability

To the maximum extent permitted by law, Nonna’s Shop, its owners, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:

  • The use or inability to use the website;
  • Product defects, errors, or omissions;
  • Delays or failures by third-party vendors; or
  • Any unauthorized access to or alteration of your data.

Your sole and exclusive remedy is to discontinue use of the website.

19. Indemnification

You agree to indemnify, defend, and hold harmless Nonna’s Shop, its affiliates, officers, employees, and agents from any claims, liabilities, losses, or expenses (including legal fees) arising out of your use of the website, your violation of these Terms, or your interaction with third-party vendors.

20. Modifications to Terms

Nonna’s Shop reserves the right to modify or update these Terms at any time without prior notice. Any such modifications shall become effective upon posting to the website.
Your continued use of the website after changes are posted constitutes acceptance of the updated Terms.

21. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
You agree that any dispute arising under or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts located in Ontario.
